A septic system you inherit as a buyer is now your maintenance obligation, your county reporting requirement, and eventually your repair bill. A little diligence before closing is cheap compared to finding out about a failed drainfield after you own it.

Ask the seller

  • What type of system is it: conventional, mound, at-grade, aerobic, or holding tank? See septic system types in Wisconsin.
  • When was it last pumped and inspected, and do they have the receipt or report?
  • Has it ever failed, backed up, or needed a repair?
  • Where exactly is the tank and drainfield, and are the lids accessible or buried?

Check the county record

Several Wisconsin counties keep a public or semi-public POWTS maintenance record you can check directly, without relying on the seller’s memory. Walworth and Ozaukee, for example, run their own online lookup tools, see Walworth County septic rules and Ozaukee County septic rules. If your county does not have a public lookup, call the environmental health or land use office directly with the parcel address.

Put an inspection contingency in the offer

A septic inspection contingency lets you walk away or renegotiate if the system fails inspection, the same way a home inspection contingency works for the house itself. Do not skip this to make an offer look cleaner on an older home with an unknown system history.

If the pre-closing inspection includes pumping and a filed report, it can also start your ownership on a documented maintenance record with the county, rather than an unknown history.

What you inherit at closing

The county’s maintenance tracking program does not reset with a sale. Whatever the cycle is on that system continues, and the next reminder card will come to you. Confirm when the next service is actually due before closing so it is not a surprise in your first year of ownership.

A buyer-ordered inspection, or at minimum a review of the seller's report by your own inspector, is worth the cost on a system you are about to be responsible for.
What if the county has no record for the property
That can mean an old, undocumented, or unpermitted system. Treat it as a reason to inspect more carefully, not less.
